In January 2023, a nursing home resident, Mr. B, with dementia, fell to his death from a vacant balcony at a nursing home in Ganghwa County, Incheon City. Ms. A, a caregiver, was alone caring for 16 elderly residents at the time. Despite Mr. B's severe delirium symptoms due to dementia, the nursing home was accused of negligent safety management and charged with workplace manslaughter. However, the court ruled that the nursing home is not a prison and that Mr. B's fall was an unpredictable accident. Consequently, both Ms. A, the caregiver, and Mr. C, the nursing home director, were acquitted.
