Mr. A, in his 20s, caused a fatal accident while driving at a speed of 104 km/h under the influence of alcohol. His blood alcohol concentration was 0.131%, more than twice the speed limit of 50 km/h. The accident resulted in the death of Mr. B, the victim. Mr. A was indicted on charges of dangerous driving resulting in death under the Act on Aggravated Punishment for Specific Crimes and drunk driving under the Road Traffic Act. While the first instance court sentenced him to four years in prison, the appellate court increased the sentence to five years, evaluating Mr. A's culpability more severely.
