The Supreme Court ruled that the second instance court's conviction based solely on circumstantial evidence without direct evidence violated the principle of adversarial proceedings. The Supreme Court pointed out that it is inappropriate to overturn the first instance judgment without further investigation and that A and B should be questioned as witnesses again. Ultimately, the Supreme Court remanded the case back to the Seoul Central District Court.
