For 64 years, the current Military Service Act Article 76 Paragraph 1, which dismissed conscientious objectors, has been declared unconstitutional. The Constitutional Court ruled that the provision requiring employers to collectively dismiss conscientious objectors violated the Constitution, but it decided to grant an opportunity for justification by recognizing the necessity of the dismissal provision. As a result, the National Assembly must revise the relevant provision by February 2028. Conscientious objectors expressed their welcome while raising concerns that the absence of a justification procedure in the unconstitutionality ruling.
